If you do not agree to these Terms, you may not access or use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

HiArt provides an AI-powered design workspace for image and video generation, canvas-based editing, project management, and related creative tools. Features, models, and pricing may change over time as we improve the product.

3. Account Registration

You must provide accurate account information and keep your credentials secure. You are responsible for all activity under your account. Notify us promptly if you suspect unauthorized access.

4. Acceptable Use

You agree not to misuse the Service. Prohibited activities include, without limitation:

  • Generating or distributing unlawful, harmful, abusive, or infringing content
  • Attempting to reverse engineer, scrape, or disrupt the Service
  • Circumventing usage limits, credit systems, or access controls
  • Using the Service to create deepfakes, non-consensual imagery, or content that violates others' rights
  • Reselling or sublicensing the Service without our written permission

5. Intellectual Property

HiArt and its licensors retain all rights in the Service, including software, branding, and documentation. You retain ownership of content you upload, subject to the license you grant us to operate the Service.

6. AI-Generated Content

Outputs generated through the Service may be subject to third-party model terms and applicable law. You are responsible for reviewing outputs before use and ensuring your use complies with these Terms and all applicable regulations.

We do not guarantee that generated content is unique, error-free, or suitable for any particular purpose.

7. Credits and Payments

Certain features require credits or paid plans. Prices, credit consumption, and plan details are shown in the product and may be updated with reasonable notice where required. Except where required by law, fees are non-refundable once credits are consumed or a billing period has started.

8. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, create risk for other users, or as required by law. Upon termination, your right to use the Service ends, though certain provisions will survive.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, HiArt will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from your use of the Service.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use after changes become effective constitutes acceptance of the revised Terms.
